The proof document required in a particular proceeding depends on the court, tribunal, document, and applicable rules. File & Serve records its own attendances and can provide documents based on that factual record, but it does not decide what legal form a client requires.
Service Confirmation / Proof of Service
File & Serve provides an applicable confirmation or proof record from the assignment history when service or attempts are completed. It describes the work recorded by File & Serve.
Commissioned affidavit when File & Serve completes service
A commissioned affidavit may be requested when File & Serve completed the service and the affidavit can be prepared from its factual service record. File & Serve does not create facts, adopt a client’s version of events, or swear an affidavit for an attendance it did not perform.
The client remains responsible for filing requirements
The client must determine whether an affidavit, certificate, confirmation, or another form is required and where and when it must be filed. Obtain legal advice when needed.
Accuracy matters
Names, dates, locations, manner of service, identity information, and exhibits must match the factual record. Corrections cannot be used to change what actually occurred.
Keep the request connected to the right file
Provide your court file number, matter reference, party names, and document description when available so the service record can be matched to the correct assignment.
